FOIA Policy

Under S.C Code Ann. §30-4-30(C), TERC has (a) 10 days, not including Saturdays, Sundays and legal holidays, to respond to respond to FOIA insofar as it relates to documents that are 24 months or less old and (b) 20 days, not including Saturdays, Sundays or legal holidays, to respond to requests insofar as it relates to documents that are more than 24 months old. 

Also under S.C Code Ann. §30-4-30(C), from the day it makes its determination that a requested document is a public record and notifies the requestor, TERC may  make available for inspection and copying documents which are 24 months or less old and 35 calendar days to provide or make available for inspection or copying documents that are more than 24 months old.  If there is to be a charge for research and copying and a deposit required under S.C Code Ann. §30-4-30(B) (which may or may not be the case here in view of the uncertainty regarding the documents requested and the on-line availability of some documents which would not incur a research and copying charge), this 30/35 days do not begin to run until the deposit is received and the full amount of the estimated research and copying costs must be paid at the time the documents are produced.
